Volkswagen Settlement

 

Oklahoma has been initially allocated approximately $21 million from the Volkswagen Environmental Mitigation Trust Agreement to reduce nitrogen oxide emissions from the transportation sector. View the Oklahoma VW Settlement Factsheet

Background

In 2016, the United States settled claims against Volkswagen, et al., concerning the use of a "defeat device" installed on 2.0 and 3.0 L diesel vehicles which resulted in air pollution emissions from these vehicles exceeding federal guidelines. States are allocated a portion of the settlement based on their number of affected vehicles. Each of these vehicles can emit up to 40 times more than the legal limit for nitrogen oxides, air pollutants which negatively impact Oklahoma's air quality and the health of citizens. On October 30, 2017, Oklahoma Governor Mary Fallin signed an executive order that designates DEQ as the lead agency for administration of Oklahoma's Volkswagen settlement trust funds. The Office of the Oklahoma Secretary of Energy and Environment is providing oversight and final approval of the mitigation plan. View the Executive Order

Timeline

  • October 25, 2016 - Settlement Effective Date
  • October 2, 2017 - Trust Effective Date (TED)
  • TED + 60 days - OK Beneficiary Certification Filing Deadline
  • December 5, 2017 - State of Oklahoma Public Meeting
  • January 30, 2018 - Trustee issues Notice of Beneficiary Designation
  • 30 days before Initial Funding Request - OK Beneficiary Mitigation Plan Deadline

Beneficiary Mitigation Plan

In order to receive these funds, DEQ must submit a Beneficiary Mitigation Plan (BMP). The BMP will be a high-level plan describing the State's intentions for utilizing Oklahoma's funding allocation, including estimated emissions reductions along with general project descriptions and locations. Funds may go towards any of ten eligible mitigation project categories. A detailed list can be found in Appendix D-2 of the settlement.

  • Freight Switchers
  • Ferries and Tugs
  • Ocean Going Vessels Shorepower
  • Class 4-7 Local Freight Trucks
  • Airport Ground Support Equipment
  • Forklifts & Port Cargo Handling
  • Light Duty Zero Emission Vehicle Supply Equipment (charging stations)
  • Diesel Emission Reduction Act (DERA) actions

Public Meeting

Listening Session
1-4 PM Tuesday, December 5, 2017

DEQ will conduct a public meeting to collect information from stakeholders and receive comments concerning the BMP. This public meeting is a listening session, providing interested persons with the opportunity for input towards the drafting of the BMP; DEQ will not be responding to questions or comments regarding the contents of the BMP at this meeting. The Department will refer to received comments as a resource in the development of the BMP. View the Public Meeting Notice

During the comment period, DEQ encourages the submission of detailed information regarding all eligible mitigation action categories, including but not limited to technical information, technology availability, cost, and estimated emission reductions if available. DEQ intends to identify eligible mitigation action categories that will provide the State with the most emission reductions for the least cost in geographic areas that carry a disproportionate share of air pollution burden, without duplicating or competing with existing assistance programs and resources. After the BMP has been written, it will be made available here, and there will be another opportunity for public comment.
