A.           OAC 252:100-23-3 Control of Emissions from Cotton Gins [AMENDED]

OAC 252:100-24-3 Control of Emissions from Grain, Feed or Seed Operations [AMENDED]

 

The Department proposes to amend 252:100-23-3(a) and 252:100-24-3(a), by replacing references to 252:100-27 with references to 252:100-19-12.  These non-substantive revisions are necessary because the substantive requirements of Subchapter 27 were moved to 252:100-19 and Subchapter 27 was revoked on June 1, 2000.

B.            OAC 252:100-5-2.2(b) Registration, Emission Inventory and Annual

                      Operating Fees [AMENDED]

           

The Department proposes increases in the annual operating fees from $17.12 to $22.28 per ton of regulated pollutant (for fee calculation) for both minor facilities and Part 70 sources.  In addition a few routine clean-up type revisions are proposed.  The fee increase will generate additional income to cover current and anticipated staffing requirements in administering the Department’s programs.

These changes were originally presented at the June 20, 2001 Council meeting and have been continued through the August 15 and October 24 hearings.  The draft rule incorporates changes suggested in earlier hearings.
