A. OAC 252:110 LEAD BASED PAINT MANAGEMENT [AMENDED]
The Department proposes to amend Subchapters 1, General Provisions;
3, Definitions; 5, Incorporation by Reference to establish these
federal Lead-based Paint hazard standards for the State of Oklahoma.
Incorporation of these amendments is necessary to maintain delegation
of the federal LBP certification and accreditation program and to
ensure that Oklahoma agencies remain eligible for federal funding.
The Department also proposes to amend Subchapters 3, Definitions;
and 11, Additional LBP Certification Requirements to more closely
reflect certification requirements for LBP services required under
other federally funded programs.

B. OAC 252:100-31 CONTROL OF EMISSION OF SULFUR COMPOUNDS [AMENDED]
In addition to amendments made to meet the Agencys re-right/de-wrong
initiative new definitions are proposed in Section 2. Section 3
on performance testing, subsection 25(a) for new sulfuric acid plants,
and subsection 25(d) for nonferrous smelters would be revoked. The
ambient air concentration limits for sulfur dioxide in Section 12
and subparagraph 26(a)(2)(B) would be revoked and the ambient air
concentration limits for hydrogen sulfide in Section 14 and paragraph
26(b)(1) would be relaxed. The emission level for the exemption
from the requirement to install sulfur recovery equipment would
be relaxed.

C. OAC 252-100-41 CONTROL OF EMISSION OF HAZARDOUS AIR POLLUTANTS
AND TOXIC AIR CONTAMINANTS [AMENDED]
Proposal will simplify language, clarify requirements, and remove
redundant requirements or language, as a part of the re-right/de-wrong
initiative. Proposed substantive changes will include the addition
of a new Appendix N, Toxic Air Contaminants.

D. OAC 252:100-5, 7, 19, 23, 24 AND 27
PERMIT EXEMPT FACILITY [AMENDED]
The Department is considering replacing the provisions for permit
by rule with a new class to be called permit exempt
facility. This will involve changes to Subchapters 5, 7, 19,
23, 24, and 37. The sections which contain the permits by rule in
Subchapter 19 for particulate matter facilities; in Subchapter 23
for cotton gins; in Subchapter 24 for grain, feed, or seed operations;
and in Subchapter 37 for VOC storage and loading facilities will
be revoked along with Appendix L. The title of Appendix H will be
changed from de minimis facilities to de minimis
activities. References to permit by rule will be deleted from
Subchapter 5 and language will be added to require permit exempt
facilities to file periodic emission inventories and to exempt them
from the requirement to pay annual operating fees. The provision
for permit by rule will be deleted from Subchapter 7 and replaced
with permit exempt facility.
