Hazardous Waste Disposal Plans
Disposal plans are required for all large quantity generators (LQG's) in Oklahoma, regardless of if they dispose of the waste in-state or export it to another state or country. Disposal plans are also required of out-of-state facilities sending hazardous waste to Oklahoma for disposal. In some cases, small quantity generators (SQG's), conditionally exempt small quantity generators (CESQG's), or even non-generators are required to possess disposal plans in the event a spill or cleanup of historical waste (with a volume exceeding 2,200 pounds) which would place them under LQG status for a brief period.
Requirements for approval of a disposal plan include submission of the complete application form , supporting documentation of the waste stream (such as analysis or detailed knowledge of process) and payment of required fees.
There are primarily two type of plans, continuous and one-times. Continuous plans do not expire and are invoiced every year on the anniversary date of the original approval to renew the plan. If you do not pay your renewal, the plan is retired. If you are still subject to dispsoal plans, and your plan is retired, you are out of compliance. One-time plans are good for 90-days. One-time plans may be used as many times as needed within the approval period. If you are generating or managing hazardous waste in this catagory for more than 90-days then you are a subject to all LQG requirements and therefore a continuous plan. Short Term LQGs or episodic LQGs should manage thier hazardous waste within the 90-day limit or notify as routine LQGs. Information required on the application include (complete instructions may be found on the reverse side of the form):
1. EPA ID Number
2. Basic generator information such as company name, mailing and plant address, and plant contact and phone number.
3. Detailed waste description. Waste name (do not use the DOT Shipping Description); EPA waste codes; Amount of waste produced (this is only an estimate and is not binding on the generator); Physical characteristics (solid, liquid, etc.); Chemical characteristics (flash point, pH, etc.)
4. Process generating waste ( eg., soil remediation, paint booth operations, TSDF consolidations, etc.)
5. Treatment, storage, disposal facility (TSDF) information (EPA I.D. Number, name and address of the TSDF)
6. Signature of plant contact (brokers & consultants are not allowed to sign in lieu of an officer of the generator)
Approval time is typically five days. In emergency situations, approvals can be obtained over the phone; however, the request must be sumitted in writing (email is typical) as to why an emergency request is needed.
Once approved, generator may obtain a copy of the generator listing from the DEQ web page. This web app does not work with IE version 10. To force it to run do this:From the “Tools” menu, select “F12 developer tools”. From this screen (at window bottom), click the button on the menu that says “Browser Mode: IE10”. A drop-down list will be displayed. Click “Internet Explorer 9”. If the waste is to be disposed of in-state, the TSD may also receive a copy of the approval from the DEQ Web page. Oklahoma generators also should download copy of the quarterly report form which is to be completed within 60 days of the end each quarter (based on the calendar year), even if no waste was shipped (out of state generators are no longer required to submit quarterly reports).
If some portion of the necessary information is not included in or with the application, usually a phone call to either the generator or the receiving facility is enough to supply the needed information. However, if there is something critically wrong with the application (such as EPA waste codes not listed on the receiving facility's permit), an email is sent to the generator explaining the delay and requesting the information.
