New Application Fee for Processing Construction and Industrial NOIs

Storm Water Program - Construction Sites

Permits are required for construction activities that disturb more than one acre, cumulative. This includes the installation or relocation of water or sewer lines that have the potential to disturb more than one acre. Construction activities that are on Indian Country Lands or are at oil and gas exploration and production related industry and pipeline operations that are under the jurisdiction of the Oklahoma Corporation Commission are regulated by the Environmental Protection Agency.

Historically, ECLS' involvement with the storm water program was during the investigation of complaints for improper sediment controls or discharges from construction sites. This year, ECLS began processing permit applications and conducting inspections of construction sites that have terminated their permit.

Permitting

A permit to discharge storm water from a construction activity must be obtained prior to the commencement of any soil disturbing activities. To receive a permit the owner/operator of the project must submit a completed Notice of Intent, DEQ Form 605-002A to the ECLS/OKC office. The owner/operator must also develop and implement a Storm Water Pollution Prevention Plan for the site.

Permits are non-transferable and may only be terminated at the completion of the project. New owner/operators of existing projects must submit an NOI for the project at least two days before assuming operational control over the site or commencing work on the site.

Permits shall be terminated at the completion of the project or when there is a change of owner/operator for the entire project. Termination means that all of the temporary sediment control measures have been removed and that the site has had 70 percent vegetative cover established.

The owner/operator terminates a permit by submitting a Notice of Termination, DEQ Form 640-572 to ECLS/OKC.

Storm Water Pollution Prevention Plan (SWP3)

A SWP3 shall be developed for each construction project and will be maintained at the site. The SWP3 shall provide information that pertains to the site description, storm water controls, maintenance, inspections and non-storm water discharges.

Construction sites that are located in an Aquatic Resource of Concern as defined in General Permit OKR10 must submit the SWP3 with their NOI.
