A. OAC 252:100-13. Open Burning.
The
Department proposes to clarify the scope of exemptions that allow open burning
for purposes of fire training. Section
9 will also be amended to exempt hydrocarbon flares from the prohibition
against burning between sunset and sunrise.

B. OAC 252:100-7. Permits for Minor Facilities.
The Department proposes revision to Subchapter 7 that will replace “permit by rule” with a new category to be called “permit exempt facility”. To do this, the Department is proposing revisions to sections in Subchapters 5, 7, 19, 23, 24, 37 and the revocation of Appendix L. This will include the elimination of annual operating fees for permit exempt facilities.

Operating Fees.
The Department is proposing an increase in the annual operating fees for major and minor sources.
